Mallory King

Owner & Attorney

Mallory King is the proud owner and attorney at Breathe. After practicing general intellectual property law for seven years, Mallory carved out a brand protection niche and took the solo leap to practice law her way. Mallory specializes in trademark, copyright, and contract, which she uses to protect her client’s branding needs.

Results oriented, Mallory has successfully helped clients register dozens of trademarks; eradicate harmful cybersquatting; acquire, understand, and enforce copyright rights; curate brand usage contracts and license agreements; draft website agreements; negotiate coexistence; navigate complex settlements; and more.

Mallory received both her bachelor’s and law degree at Michigan State University. Mallory graduated 15th in her class from MSU College of Law where she also received the highest grade in both her intellectual property and cyber law classes. Go Green!

Born and raised in beautiful Traverse City, Michigan, Mallory returned home after law school where she now lives with her husband, stepson, and dog Otis. Mallory enjoys yoga, horror movies, cooking, gardening, organizing, and a crisp, bubbly Diet Coke (preferably from McD’s!).

Fun Facts:

  • Legally Blonde and A Time to Kill inspired Mallory to become a lawyer.

  • Mallory was a Cherry Princess in the National Cherry Festival.

  • Mallory has a tendency to swear like a sailor - consider yourself warned.

Office Assistant

Otis is a five-year old Pembroke Welsh Corgi (yes - like the Queen’s dogs! May she RIP) who has been working as Mallory’s Office Assistant since he was a puppy. Unbelievably cute and unwaveringly loyal, Otis lays beneath Mallory’s feet while she works.

Otis frequently reminds Mallory to get outside for walks in the fresh air so she has a clear head and happy heart. He also encourages plenty of stress-relieving pets and kisses throughout the day.

Taking his job very seriously, Otis diligently greets clients with an enthusiastic “Woof!” at the start of every phone call and can often be spotted supervising in the Zoom background. Otis serves as security and alerts Mallory whenever a package is delivered, the garbage is collected, or the wind is rustled.

Off the clock, Otis loves to play frisbee, destroy squeaker toys, swim, hike trails, sun bathe, and follow Mallory around everywhere. Yes, literally everywhere.

Otis is a good boy and an even better Office Assistant.

  • Otis’ favorite treats are “greenies”, carrots, and mini milkbones.

  • Otis shares a birthday with Mallory (April 25th)

  • Sit and shake are the only tricks in Otis’ arsenal, unless looking adorable counts!

  • “Brand Protection” is an all-encompassing term for the three specialized areas of law best suited to protect valuable brand assets - trademark, copyright, and contract. Put another way, a brand name or logo can be protected through trademark; original works and artistic materials developed by a brand can be protected through copyright; and all brand rights can be protected through various contracts, such as license agreements or NDAs. Collectively, this trio forms the niche area of brand law.

  • Breathe is an homage to all things in life where we are reminded to breathe - in yoga; giving birth; while meditating; in times of crisis or excitement or illness; at the chiropractor; during a hard workout; standing in a long line - you get the drift. Shit, even Faith Hill told us all to “just breathe.” While Breathe serves as a reminder to Mallory in her legal practice, for her clients it’s a pinnacle for all things brand protection. So please, breathe easy while Mallory helps protect your most valuable brand assets.

  • Absolutely. If you have filed your own trademark application, Mallory can take over as your attorney of record for a small fee. Notably, foreign trademark applicants are required to have a United States licensed attorney be listed on record, which is also something Mallory can handle.

  • Yes. Response to Office Actions (“ROA”) are one of Mallory’s specialities. Mallory will first need to become the Attorney of Record for your trademark before filing a ROA. ROAs start at $1,500 flat-fee and increase depending upon complexity. Please note that some ROAs are impossible to get around and success cannot be guaranteed.

  • For sure. Mallory is able to review, edit, and update your existing contracts, or develop completely new contracts from scratch. It all depends upon your needs.

  • No (sorry, not sorry). While Mallory provides infringement enforcement services for both trademark and copyright, the line is drawn at litigation. If you need to sue or get sued, Mallory can help recommend a litigation attorney.

  • Yes! Almost all of Mallory’s clients are located outside of Michigan. Because brand protection is largely regulated by federal law, Mallory is able to provide services to clients nationwide.

  • Unfortunately, no. Mallory is not a licensed patent professional, as that requires specialized education and additional certification. If you have patent needs, Mallory recommends Aurora Consulting.
